According to Code of Virginia § 59.1-293.20 (2025), sale or distribution of a liquid nicotine or nicotine vapor product not included in the directory established by the Attorney General is prohibited beginning December 31, 2025. However, retailers can still clear the inventory in 60 days after the directory is published.

2. Are They Banning Vapes in Virginia?

Yes. Without lobbyists from the vaping industry, vapers' rights shrink, and smokers have fewer solutions to smoking cessation.

Flavors do matter. They are not designed for children but for adults who are responsible enough to quit smoking for good. The 2025 Virginia vape ban is not merely a flavor ban. It prohibits the selling and distribution of all the flavored ones except tobacco vapes. Unfortunately, even vapers fond of tobacco flavor find these vapes lame. This means Virginians can't buy disposable vapes and e-liquid after the Virginia vape ban takes effect, since they all contain liquid nicotine. The best solution could be stocking up or moving out. Empty pod cartridges and other vaping gear are banned, as these are not exempt in § 59.1-293.20 itself.

4. Is West Virginia Part of Virginia?

No. West Virginia (WV) and Virginia (VA) are two separate states. Therefore, vapers of legal age across the state border can still enjoy their favorite flavors. West Virginia does not ban vapes at all. No worries for West Virginians.

5. How Much Time Do We Have to Stock Vapes in Virginia?

Virginia Code § 59.1-293.20 leaves a window of 60 days after the directory is posted and available for the public. That means we have about 2 months to stock up on our favorite vapes, e-liquid, and pod cartridges in the face of the vape ban in Virginia.

6. What Is The Penalty For Violating VA Vape Ban?

If you are a retailer or vape shop owner, you'd better start with inventory clearance as soon as possible. Anyone selling unlisted vapor products can face a civil (not criminal) fine of $1,000 per day per SKU until compliance. Since the FDA is famous for excluding submission of some vape brands, you are technically financing the government forever by selling vapes people really love, as none of them will be listed in 10 years.
